Taxes in India are levied by the Central Government and the State Governments. Some minor taxes are also levied by the local authorities such the Municipality or the Local Council.

The authority to levy a tax is derived from the Constitution of India which allocates the power to levy various taxes between the Centre and the State. An important restriction on this power is Article 265 of the Constitution which states that "No tax shall be levied or collected except by the authority of law." Therefore each tax levied or collected has to be backed by an accompanying law, passed either by the Parliament or the State Legislature.

Central Board of Direct Taxes

The Central Board of Direct Taxes (CBDT) is a part of the Department of Revenue in the Ministry of Finance, Government of India. The CBDT provides essential inputs for policy and planning of direct taxes in India and is also responsible for administration of the direct tax laws through Income Tax Department. The CBDT is a statutory authority functioning under the Central Board of Revenue Act, 1963. its not true though

Double taxation treaties between India & Spain?
Q. I am paid by an Indian company for consultancy services, but I am registered as self employed and live in Spain. When I submit my invoice each month the Indian company is deducting taxes in India. The Spainish Government indicate that they should not be doing this and that they will not honor any tax certificate. That taxes need to be paid in Spain if I reside in Spain. The Indian company say that they have to deduct these taxes in India and at the end of the financial year they will provide a certificate. This is causing many problems this way. Is it correct that they have to deduct taxes in India?

A. I think so. If you really want to know about the treaty you have to ask at the Indian consulate. But, if you are resident in Spain you are, strictly speaking, working there. But you are being paid in India. Have you made a contract with the Indian company? Which currency do they use? If they pay you directly in Spain, Treaten them to be reported to the Indian government.

A. There is no particular subject called Taxation , it's just a part of several Degrees. For instance CA , if you intend to finish CA , taxation is one of the subjects .
